Litigation before a judge or jury is only one way a legal dispute may be resolved. Another way, which is becoming more common, is mediation. Mediation is an opportunity for the parties who have a disagreement to meet with a neutral third-party who will help facilitate a discussion between the parties of the issues with the goal of reaching a resolution without the need for further litigation or court involvement. A mediator does not impose a decision or outcome on the participants but instead utilizes a specific process to guide the conversation toward a mutually agreeable resolution. An arbitrator, on the other hand, does render a binding decision on the parties after the presentation of evidence very similar to a trial before a judge or jury.
