Misdemeanor Offenses

Misdemeanor offenses may carry up to a year in jail and up to a $2500 fine. Some examples of misdemeanors are assault, battery, public intoxication, disorderly conduct, and harassment. A misdemeanor conviction may negatively affect your gun rights, may show up on background checks, and may affect future employment opportunities. DUI & DWI

Driving While Intoxicated– Driving while intoxicated (“DWI”) is the charge of operating or being in actual physical control of a vehicle or motorboat by a person of any age if that person is either intoxicated or the alcohol concentration in a person’s breath or blood is 0.08% or higher.

Driving under the Influence– Driving under the influence (“DUI”) is the charge of operating or being in actual physical control of a vehicle or motorboat by a person under the age of 21 if the person is either influenced by any intoxicant or the alcohol concentration in a person’s breath or blood is 0.02% but less than 0.08%.
